The Apple Software licensed hereunder contains or otherwise provides access to fonts, graphics, artwork, images, and similar content (“Symbols”) for use in accordance with this License. Subject to the terms of this License and your compliance with Apple’s Human Interface Guidelines, you are granted a limited, non-transferable, non-exclusive license to install and use a reasonable number of copies of the Apple Software internally within your company or organization for the limited purpose of using Symbols from the Apple Software to create mock-ups of user interfaces to be used in software products running on the applicable Apple Platforms (as defined below). | |
| Your use of Symbols obtained from Apple’s SF Font is limited to creating mock-ups of user interfaces for software products running on Apple’s iOS, iPadOS, macOS and tvOS operating systems and your use of Symbols obtained from Apple’s SF Compact Font is limited to creating mock-ups of user interfaces for software products running on Apple’s iOS, iPadOS, macOS, tvOS and watchOS operating systems. Such Apple operating systems are referred to as the “Apple Platforms”. Your use of individual Symbols shall also be subject to any specific use restrictions with respect thereto as set forth in the Apple Software or Apple’s Human Interface Guidelines. | |
| B. Limited License for Templates. The Apple Software may enable the user to generate editable templates of certain Symbols in an svg file format (“Template(s)”). Subject to the terms of this License and your compliance with Apple’s Human Interface Guidelines, you are granted a limited, non-transferable, non-exclusive license to install and use a reasonable number of copies of the Apple Software internally within your company or organization for the limited purposes of: | |
| (i) generating Templates using the Apple Software; | |
| (ii) modifying or having modifications made to Templates generated by the Apple Software; | |
| (iii) using modified Templates to create mock-ups of user interfaces to be used in software products running on an Apple Platform; and | |
| (iv) incorporating and distributing such modified Templates in your software products running on the applicable Apple Platforms, provided that such modified Templates are incorporated into your software products exclusively through the use of Apple’s Xcode application. | |
| If you modify a Template in accordance with this Section 2B, you agree not to modify such Template or the Symbols contained therein for any unlawful or illegal activity, nor to create any modifications that are offensive or inappropriate. | |
| C. Ownership of Templates. As between the parties, and except as otherwise provided in this License, Apple shall retain all rights, title, and interest in and to Templates generated by the Apple Software. As between you and Apple and subject to any of Apple’s rights in the underlying Template (pre-existing or otherwise), you shall own all rights, title, and interest in and to any and all modifications made to Templates by you or on your behalf in accordance with this License. | |
| D. Limited Distribution of Templates and Mock-Ups. You may distribute: (a) Templates, as generated by the Apple Software or as subsequently modified by you; and (b) your mock-ups containing Symbols or modified Templates, in the case of each of (a) and (b) above, for the specific purpose of allowing third-parties (each, an “Agent”) to assist in the design or development of your software product in accordance with this License. To the extent that you distribute such materials to your Agent, you agree to ensure that such Agent is aware of the restrictions set forth in this License including, without limitation, the limited license rights described in Sections 2A, 2B and the requirement that the Symbols and Templates be used only for software products that run on applicable Apple Platforms. You further agree to be responsible for the compliance of your Agent with the terms and conditions of this License and will be responsible for any violations by your Agent hereof. | |
| The foregoing rights in Sections 2A and 2B(iii) include the right to show the Symbols and modified Templates in screen shots, images, mock-ups or other depictions, digital and/or print, of such software products running solely on the applicable Apple Platforms. | |
| Except as expressly provided herein, Symbols and Templates may not otherwise be used, extracted, copied, modified, distributed, embedded or repackaged as content, images, samples, clip art, or similar assets. | |
| E. Other Use Restrictions. This License does not grant you any rights in any trademarks, service marks, trade names, or logos of Apple or any third party that may be referenced or included within the Apple Software, and any such trademarks, service marks, trade names, or logos are expressly excluded from the definition of “Template”. You agree that you shall not use or incorporate the Symbols or any substantially or confusingly similar images into app icons, logos or make any other trademark use of the Symbols. Apple reserves the right to review and, in its sole discretion, require modification or discontinuance of use of any Symbol used in violation of the foregoing restrictions, and you agree to promptly comply with any such request. You agree not remove, obscure, or alter any proprietary notices (including trademark and copyright notices) that may be affixed to or contained within the Apple Software, Symbols or Templates. | |
